Terms of Service

The service

Fortsend provides a control plane for transactional email: domain verification, mailbox provisioning, API keys, and an email sending API. By creating a workspace or calling the API you agree to these terms.

Acceptable use

Fortsend is for transactional and operational email to recipients who expect it. You must not use it to send:

• unsolicited bulk email or purchased-list marketing,
• phishing, malware, or content that impersonates another party,
• content that is unlawful in your jurisdiction or your recipients’,
• mail from domains you do not control.

You are responsible for complying with applicable email regulations (such as CAN-SPAM, CASL, and GDPR) for the messages you send. We may throttle, suspend, or terminate workspaces that endanger deliverability or violate this policy, with notice where practical.

Your account

Keep your credentials and API keys confidential; activity performed with your keys is your responsibility. Revoke keys immediately if you suspect they are compromised.

Fees

Current pricing is published on the pricing page. During early access, usage above the free allowance is invoiced monthly. We will give at least 30 days’ notice before pricing changes take effect.

Service quality

Fortsend is provided “as is” during early access, without warranties of uninterrupted service or guaranteed inbox placement. We work to keep the service reliable but email delivery ultimately depends on receiving providers and your domain reputation.

Liability

To the maximum extent permitted by law, Fortsend’s aggregate liability for claims arising out of the service is limited to the amounts you paid us in the three months preceding the claim. We are not liable for indirect or consequential damages, including lost profits or lost data.

Termination

You may stop using the service and delete your workspace data at any time. We may suspend or terminate access for breach of these terms. Sections that by their nature should survive (fees owed, liability limits) survive termination.
